Important Legal Information
General
The user is solely responsible to provide valid and accurate
information needed to complete PaysGold Interexchange
Service orders.
The user is solely
responsible for all payments, even if the instructions
provided by user are incorrect.
Users must be aware that
transfer of Digital Gold Currency into wrong Digital Gold
Currency accounts due to wrong account numbers given by the
user are not reversible. We have no powers to retrieve
Digital Gold Currency placed in another users account. You
simply must give us the correct account number to prevent
this from happening.
PaysGold Interexchange
Service orders are binding contracts between the user and
PaysGold Interexchange Service Inc. and will be honoured by
the user. Payment must be good funds of the exact amount
specified in the user's order, net of all fees.
If the user fails to remit
good funds of the exact amount specified in the users order,
net of all fees, PaysGold Interexchange Service Inc., at its
sole discretion, may reduce the PaysGold Interexchange
Service order to the amount of funds received.
If the user remits more
than the amount of good funds necessary to fulfill their
order, net of all fees, then PaysGold Interexchange Service
International Inc., at its sole discretion, may:
(i) adjust the users
order to the exact amount of funds received,
(ii) enter a new order for the amount of the excess
funds received at the exchange rate at the time of the
entry of the new order.
　
Payment may not be
counterfeit or otherwise fraudulent. The user agrees that
any attempt to remit fraudulent funds will result in
prosecution to the fullest extent of the law and the
notification of the general public of user's actions via
posting on the PaysGold Interexchange Service website,
public and private discussion boards or by any other means,
at PaysGold Interexchange Service Inc.'s discretion.
Payments are final and not
reversible except as provided in this Agreement.
Any tax consequences of
PaysGold Interexchange Service orders and or transactions
are the sole responsibility of the user.
The Digital Gold Currency
payment to the Digital Gold Currency account nominated by
the user in their order will occur, subject to availability,
within 48 hours of the funds being fully cleared and
received to the satisfaction of PaysGold Interexchange
Service Inc..
In the case of domestic bank cheques and International
cheques (i.e. foreign currency cheques sent to the UK,
Australia or any of our offshore banks) and money orders
from any source, the funds will not be accepted and will be
returned by PaysGold Interexchange Service Inc.
We reserve the right to
refuse service to particular individuals or entities, at our
sole discretion, with or without cause. NO correspondence
will be entered into.
We reserve the right to
report any fraudulent activity to the appropriate
authorities.
Members must supply a valid
landline telephone number in which PaysGold Interexchange
Service staff can call to verify membership contact and
order details. We reserve the right to cancel pending orders
if we are unable to make contact. Mobile phone numbers are
not permitted. This is a due diligence requirement to avoid
fraud and as we are a money service business we are required
by British and Australian financial regulations to perform
this task if required.
This service is
independently operated and is neither endorsed by nor
affiliated with e-gold Ltd, Omnipay, G&SR, GoldMoney,
e-Bullion, Pecunix, NetPay or Evocash. In the event of any
questions about this service and/or your order, you should
contact us directly at support@paysgold.com. Please do not
contact e-gold Ltd, Omnipay, G&SR, GoldMoney e-Bullion,
Pecunix, NetPay or Evocash about this order, as they will
not be able to help you with any issue relating to this
service.
All transactions into or
out of or between accounts of Digital Gold Currency
operators shall be subject to the Terms & Conditions of
those operators as outlined on their respective web sites.
Force Majeur. PaysGold
Interexchange Service Inc. will not be responsible for
delays or failures in the transmission, receipt or execution
of orders, remittances, payments, or information due to
events or systems beyond its control. The obligations of
this contract precede any government enactment. PaysGold
Interexchange Service Inc., it's owners, employees, agents
or affiliates will not be responsible for any loss, damage
or injury resulting from any event or system beyond its
control.
PaysGold Interexchange
Service Inc. will not fulfil any exchange transactions
ordered by the user if the user uses, or attempts to use the
PaysGold Interexchange Service service in connection with
tampering, modifying or otherwise corrupting the security or
functionality of the PaysGold Interexchange Service
services. Additionally, the user will be subject to damages
and other penalties, including criminal prosecution where
available and the notification of the general public of the
user's actions, at the sole discretion of PaysGold
Interexchange Service Inc..
PaysGold Interexchange
Service Inc. will not fulfil any exchange transactions
ordered by the user, if ordered not to do so by an order
from a court or arbitration body of acceptable jurisdiction
or official body or group such as a Market Makers
Association, or gold supplier such as e-gold or e-Bullion
for example, or as determined by PaysGold Interexchange
Service Inc..
The user is solely
completely responsible for the Digital Gold Currency account
given in any order to PaysGold Interexchange Service Inc.
and the contents and disposal of contents thereof. PaysGold
Interexchange Service Inc. will not be held responsible for
the use or disposal of the value or contents of any Digital
Gold Currency account. This especially includes investment
programs. We are not affiliated to, nor do we endorse
investment programs. If our banner or link appears on any
such program this is merely an advertisement of our
services. We stress the danger involved in any such programs
and suggest extreme caution before spending any amount of
Digital Gold Currency.
The PaysGold Interexchange
Service Inc. does not operate it's own investment program.
Security
PaysGold Interexchange Service Inc. (using the enterprise
name of The PaysGold Interexchange Service) takes the
security and privacy of its systems and its customers' data
very seriously. We constantly review our systems and data to
ensure the best possible service to our customers.
Parliament has created specific offences for unauthorised
actions against computer systems and data. PaysGold
Interexchange Service Inc. will investigate any such actions
with a view to prosecuting and/or taking civil proceedings
to recover damages against those responsible.
Exclusions and
Limitations
The information on this web site is provided on an "as is"
basis. To the fullest extent permitted by law, PaysGold
